MNSure’s Unreasonable Search and Seizure – I Plead The 4th
There is a new trend in Government, data is collected and shared with law enforcement and the IRS. Don’t worry though, its “just in case” you break the law. Of course this runs amuck of the Constitution, but that document is completely ignored now by politicians and agents of Government.
4th Amendment: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
At the Federal level, the SAFE Act does a similar thing, including sending your finger prints and an FBI background check to the Department of Justice where it will be stored – just in case.
I saw a story on Drudge this morning about Maryland’s “marketplace” and how personal data is “protected” – more properly put – used to implicate you in a crime.
The policy contains many standard statements about information automatically collected regarding Internet browsers and IP addresses, temporary “cookies” used by the site, and website accessibility. However, at least two conditions may give some users pause before proceeding.
The first is regarding personal information submitted with an application for those users who follow through on the sign up process all the way to the end. The policy states that all information to help in applying for coverage and even for making a payment will be kept strictly confidential and only be used to carry out the function of the marketplace. There is, however, an exception: “[W]e may share information provided in your application with the appropriate authorities for law enforcement and audit activities.”
Obamacare is a Federal law requiring ‘marketplaces’ so chances are every state will be the same….. MNSure is Mark Dayton’s version of Obamacare, I wonder what it does with data. Via MNSure’s terms and conditions page (aka what you must agree with to comply with this federal mandate. (AKA involuntary search and seizure)
With whom may we share information?
We will only share information about you as needed and as allowed or required by law. We may share your information with agencies or persons who need the information to do their jobs, such as MNsure employees, investigators and auditors, community assistance partners you are working with, law enforcement officials, other state, federal and local governmental agencies, your health care insurer, agency, managed care organization or others who pay for your care, and anyone else authorized by law to receive the information
What happened to the 4th Amendment?
I know defenders of Obama will quickly point out that most websites include similar language, but Obamacare is a mandate. Its involuntary (unless you helped elect Obama and Democrats and are owed a political favor so are granted a waver).
I guess Nancy Pelosi was right, we Congress did have to pass the bill before we could read the bill.
Just a reminder to everyone: Senator Al Franken was the deciding vote in passing Obamacare. Upon completion of his successful theft of the 2008 election recount, he became the 60th vote in the US Senate giving Democrats the ability to break a GOP filibuster on this disastrous law.
